What Is Estate Management?

Estate management, or estate administration, is the work that follows a grant of probate or letters of administration. The executor or administrator must collect the assets of the estate, pay any debts and taxes, and then distribute what remains to the people legally entitled to it.

These duties are personal and enforceable. An executor who distributes an estate incorrectly can be held personally liable by beneficiaries or creditors, which is why careful legal guidance matters.

The Duties of an Executor or Administrator

Whether you are named as executor in a will or appointed as administrator by the Court, the core responsibilities are broadly the same.

Identifying and Securing Assets

Locating bank accounts, superannuation, shares, insurance policies, and real property, and ensuring each is protected and appropriately insured while the estate is administered.

Paying Debts and Liabilities

Identifying creditors, settling outstanding liabilities, and finalising the deceased's tax affairs before any distribution is made to beneficiaries.

Distributing to Beneficiaries

Distributing the estate strictly in accordance with the will, or with Victorian intestacy rules where there is no will, and keeping proper records of every distribution.

Managing Estate Property

Advising on the transfer, retention, or sale of estate real property, including the conveyancing work required to complete a transfer to a beneficiary or purchaser.
